Terms of Use
Terms governing use of this website and B2B commercial enquiries.
Last updated: 30 October 2026
Scope
These terms apply to the JMSA Banana website and to enquiries submitted through it. They are intended for business users. They do not create rights for consumers.
Information and quotes
Product descriptions, specifications, availability, volumes, transit times and indicative prices are for general information and may change. A quote is not a binding offer unless it says so in writing.
A binding supply arrangement requires a written sales contract or order confirmation signed by both parties.
Orders and Incoterms
Orders are subject to product availability, agreed specifications, packing requirements, payment terms and written confirmation.
Unless the contract says otherwise, international sales are governed by the Incoterms 2020 rules for the named trade term.
Quality and claims
Quality is assessed against the specification agreed in the contract. Buyers must inspect shipments promptly and notify us of any claim within the period stated in the contract, with supporting evidence.
Natural variation in fresh produce is expected. We do not warrant that every finger, bunch or carton will be identical.
Delivery and risk
Delivery, risk and cost allocation follow the agreed Incoterm and contract. Dates are estimates unless expressly guaranteed.
Delays caused by carriers, ports, weather, inspections or other events outside our reasonable control may affect timing.
Intellectual property
The content, branding and design of this website belong to JMSA Banana or its licensors. You may not copy or reuse them for commercial purposes without written permission.
Liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit or loss of market. Our total liability is limited to the value of the relevant supply contract.
Nothing in these terms excludes liability that cannot lawfully be excluded.
Force majeure
Neither party is liable for failure to perform caused by events beyond its reasonable control, including natural disasters, strikes, port closures, carrier failures, government action or disease-related restrictions.
Governing law
These terms are governed by the laws of Angola. Disputes should first be discussed in good faith; if unresolved, they may be submitted to the competent courts in Angola.
